A thought I had driving to Ringwood this morning..............How can you stop and charge someone when they are empty if you don't know what they intend to carry on the way back?

Dear Mrs Blunden,

Thank you for your email of 10 August to Norman Baker regarding correspondence received on the subject of tachographs. Your email has been passed to me as my team has responsibility for this area of policy.

Norman Baker’s letter refers to the exemption from the EU drivers’ hours rules for vehicles under 7.5 tonnes used for the non-commercial carriage of goods. Transporting animals, moving house, or using a caravan, as you mention in your email, would fall within this exemption.

The differentiation in the definition between “commercial” and “non-commercial” that the Department uses relates to whether or not the operation is being carried out with a view to making a profit. This view was taken from case law.

As Norman Baker’s letter states, the legislation concerning drivers’ hours for these vehicles was agreed in 2007 following 5 years of negotiation between Member States and extensive formal public consultation. We are not aware of any future plans to renegotiate the legislation at the current time.

Dear Tom,
I was not questioning what the rules are I am questioning why. They make absolutely no sense at all and now you are telling me that a farmer taking his animals to market is not with a view to making profit! I know agriculture is in a bad way but I know of no farmers that drive their animals about just for fun! Does this mean that to make profit out of animals you must drive them more than 50km?
Do milk tanker drivers pick up milk from the farms just to tip it down the drain or is someone intending to make money out of it somewhere along the line?
Timber lorries which must surely have a MAM of over 3.5t can drive about all day within a 50k radius of base but step outside that and tachographs are needed, how is that related to profit?
Instead of keep telling me what the rules are could you please explain how you satisfy yourselves that profit and safety go hand in hand and how you can justify having two identical vehicles with the same MAM, one needing a tacho and one not when obviously neither of the drivers are travelling about ‘just for fun’. I could go on and on with many more examples but hopefully you are getting an idea of what I mean, there are one or two more comments on my web site from others who find your reasoning equally baffling.
I look forward to your explanation rather than just another lecture on the rules as they stand.

I apologise if it appeared that the Minister did not respond promptly to the concerns you set out in an e mail to Francis Maude MP regarding tachographs. However, a letter addressing the issues you raised was dispatched from the Department to Francis Maude on the 4 August which I have attached for your information.

Dear Katy,
If anyone had bothered to read my first email dated 10/8/10 sent directly to you, they would have realised that that was in response to the letter dispatched from the department to Frances Maude. I have to say it concerns me that the people ‘running’ the country have such trouble understanding fairly simple emails!

Please could you let me know what would be a normal length of time to expect to wait for an acknowledgement to an email and if you have bothered to take the time to look at our concerns. Now that it has been pointed out to you how ridiculous the result of 5 years of European negotiations seems to be do you have any plans to change it?

Sara,
Firstly thank you for explaining it all to us very well. I perfectly understand the situation re doing a full time menu and food every night, personally I don't think it would be worth your time & trouble.
Now the friday/saturday thing might work.
Something you used to do in the past was the theme evenings, Burns Night a couple of years ago was fabulous, so maybe you could start by trying a few nights like that?

One thing I do like is your rolls on a saturday if I get there in time & there are some left. So if you are to take the Real Ale Pub theme a little further you could do worse than look at how another favorite pub of mine, All Nations in Madeley, does things. They do a lot of 'toasties' sandwiches & baps, also pasties and pies, all at great prices. I realise that lot may be a little to 'working class' for the Surrey/Sussex borders, but personnally I think it would nice and help soak up the beer,you get the idea of what I mean.
Hey we could even get one of those 'Pukka Pies' heated glass cabinets for the end of the bar! Sorry, I slipped into Royal Oak humour there for a moment, I hope no one from BITE reads it, they'll get offended!

Well thats my currant thoughts anyway, but whatever you decide we'll be behind you.

Whenever I have had the fortune to eat at The Royal Oak - the food has been superb and huge in quantity. I for one would certainly support you on a Friday and Saturday evening if you decide to get someone in.

beer & running the pub
Sara,
Thank you very much for the beer & signed Bottle Beer Guide, you didn't have too but it was much appreciated. There are some stonking beers in there, a couple I've had,two of my fav US beers of all time & some stuff I've never heard of.
It was a pleasure to help out by running the pub over the weekend with the beerbabe and the least we could do to help you out as you have always made us so welcome in what people forget, is your house.
I have to say after a weeks work to then run the pub and then go straight back into another weeks work especially as we are trying to relocate,was knackering - Can I go to sleep now?

Lager Locals
BAN the closet lager drinking locals...I'm shocked & horified that I know,talk & drink with them...What is to be done?
It's almost as bad as sharing the bar with one of the BITE knobs 'sussexfox','wealdman',wolfdog','sillysam',or 'dolphox'.
No offence to the likes og 'TWG',Cider_Al','Big_Gee','fullbelly' or 'hopbitch' though.

Sara,
Still trying to get my head around Iain winning the World Championship or should it be Chumpionship! of salad eating. All we needed was a salad dressing made from lager and I feel it would have been complete!!!
When I was told the news on sunday afternoon after some of the Tug-o-war boys returned home with their tails between their legs, I was tempted to drop Iain glass from behind the bar. Why? Because I think he deserves a new one with....SALAD BOY...on it,or better still WORLD CHAMPION...Well done Iain.
